SJI sent a submission to the United Nations Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment following his call for inputs on the theme of "domestic violence and the prohibition of torture and ill-treatment."
The special rapporteur will utilize submissions received for an upcoming report which aims to: (1) to apply the substantive elements of the definition of torture and other cruel, inhuman or degrading treatment or punishment to a broad range of practices commonly understood to fall within the notion of domestic violence; (2) to analyze the legal obligations arising for States under the prohibition of torture and other cruel, inhuman or degrading treatment or punishment with respect to domestic violence, and (3) to make recommendations with a view to improving the protection against torture and other cruel, inhuman or degrading treatment or punishment in the context of domestic violence.
SJI's submission provides an overview of the kinds of violence and abuse its clients have been subjected to in domestic violence cases and the lack of effective remedies, and also provided information on harmful traditional practices occuring in particular regions of Russia, such as bride-kidnapping, forced marriage and female genital mutilation.
